I have a nephew who was born here in the Philippines but his dad is a US citizen. We have also found out somewhere online that my nephew is a US citizen. Do we have to file for dual citizenship for my nephew? He is turning 12 this September.

And here is Bob’s answer for Yeli:
Hi Yeli – Your nephew is not a US Citizen, although he can be, if his father wants him to be. The process is that his father will have to file a petition for a birth abroad at the US Embassy in Manila. They may or may not do a DNA test to prove paternity, and will then issue US Citizenship for your nephew. At that point, he will be a dual citizen. However, if the father is not willing to do this, your nephew cannot obtain US Citizenship.
