My son was born in california while I am just a green card holder. Therefore is he a Dual Citizen automatically. He went home with me back and forth and the last time he came back 2006. Then I lost his passport from moving to another state. He is trying to get a passport now in our Philippine consulate in Los Angeles for he is going home by August4, 2011. His plane ticket is for one way only can he go home in the philippine with out the Philippne passport and get one in the Philippine when he arrive
Firstly, your assumption about your son’s citizenship is incorrect. By being born in the USA, he is automatically a US citizen. However, he is by no means a Philippine Citizen, even if you are one. You would have to file a report of birth abroad to the Philippine Embassy or Consulate, and after you do that, then your son is a Dual Citizen, but not until that is complete.
Regarding travel, your son may go to the Philippines on his US passport, but it could present problems. If he travels on his US passport, he is subject to the laws that affect foreigners, not Filipinos. So, for example, he may not be allowed to enter without an ongoing ticket, as he has no right to stay in the Philippine permanently. All Bureau of Immigration regulations would apply to your son.
So, yes, he can do it, but it will also present some challenges.
